FREEDIVE GEELONG TERMS AND CONDITIONS

1. Acceptance of Terms

By booking, attending or participating in any course, training session, snorkel, charter, excursion, workshop or ocean-based activity conducted by Freedive Geelong Pty Ltd (“Freedive Geelong”), you agree to be bound by these Terms & Conditions.

Participation in any activity is conditional upon acceptance of these Terms.

2. Nature of Activities & Assumption of Risk

Freedive Geelong conducts freediving, snorkelling, breath-hold training, night snorkels, boat-based activities and related marine education programs.

Participants acknowledge that these activities involve inherent risks, including but not limited to:

  • Shallow water blackout

  • Hypoxic loss of consciousness

  • Barotrauma

  • Drowning

  • Marine life interaction

  • Environmental hazards (currents, swell, visibility changes, weather)

  • Slips and falls on wet surfaces

  • Vessel movement and embarkation risks

  • Equipment malfunction

By participating, you voluntarily assume all risks associated with these activities.

Nothing in these Terms excludes rights or guarantees under the Australian Consumer Law.

3. Medical Fitness & Participant Responsibility

All participants must:

  • Be medically fit to participate

  • Complete required medical declarations prior to activity

  • Provide medical clearance where indicated

  • Not participate under the influence of alcohol or impairing drugs

Participants must inform Freedive Geelong of any change in medical condition prior to participation.

Freedive Geelong reserves the right to refuse participation if safety concerns arise.

4. Freediving-Specific Safety Requirements

Participants in freediving activities agree that they will:

  • Never dive alone

  • Follow one-up / one-down buddy procedures

  • Not hyperventilate

  • Adhere to instructor-imposed depth and time limits

  • Immediately report symptoms such as dizziness, discomfort or ear pain

Freediving involves voluntary breath-hold and hypoxic exposure, and loss of consciousness may occur without warning.

5. Night Activities & Low Visibility

For night snorkels or low-visibility conditions, participants acknowledge that:

  • Visibility may be reduced

  • Marine life behaviour differs from daytime

  • They must remain within group boundaries

  • They must carry appropriate lighting equipment where required

Failure to comply with safety instructions may result in removal from the activity.

6. Vessel & Marine Environment Conditions

For boat-based activities, participants acknowledge risks associated with:

  • Boarding and disembarking vessels

  • Vessel movement

  • Changing weather conditions

  • Slippery decks and surfaces

All participants must follow instructions from the skipper and crew at all times.

7. Instructor & Operational Authority

Freedive Geelong instructors, guides and vessel operators have full authority over operational and safety decisions.

This includes the right to:

  • Modify activity locations

  • Adjust session structure

  • Limit participation

  • Remove participants from water

  • Cancel or terminate activities

All safety decisions are final.

8. Bookings & Payment

Full payment is required prior to activity commencement unless otherwise agreed.

Bookings are confirmed only upon receipt of payment.

Freedive Geelong reserves the right to deny participation where payment has not been received.

9. Cancellation & Rescheduling Policy

Courses & Programs

  • More than 7 days’ notice: booking transferable to another date within 12 months (one transfer permitted).

  • Within 7 days: non-refundable.

  • No-show: non-refundable.

  • Medical certificate provided within 7 days may allow rescheduling (fees may apply).

Tours, Snorkels & Excursions

  • 7+ days’ notice: 10% administration fee.

  • Between 7 days and 24 hours: 50% cancellation fee.

  • Within 24 hours: 100% cancellation fee.

  • No-show: 100% fee.

Reschedules are subject to availability.

10. Weather & Environmental Changes

Ocean and weather conditions are dynamic.

Freedive Geelong may modify, relocate, postpone or cancel activities due to:

  • Weather

  • Marine conditions

  • Visibility

  • Government or safety directives

​

If Freedive Geelong cancels an activity, participants will be offered:

  • Rescheduling

  • Credit

  • Refund

​

Freedive Geelong is not responsible for travel, accommodation or incidental costs.

​

11. Minimum Numbers

Certain activities require minimum participant numbers. If minimum numbers are not met, participants may be offered:

  • Transfer to another date

  • Credit

  • Refund

​

12. Equipment Rental

Participants hiring equipment are responsible for:

  • Inspecting equipment prior to use

  • Reporting defects immediately

  • Returning equipment in good condition

Loss, damage or negligent misuse may result in repair or replacement charges. Security deposits may apply.

13. Photography & Media

Freedive Geelong may capture photographs and video during activities for promotional and educational purposes. If you do not wish to appear in media content, you must notify Freedive Geelong in writing prior to participation. Parent or guardian consent is required for participants under 18 years of age.

14. Limitation of Liability

To the extent permitted by law, Freedive Geelong’s liability is limited to:

  • Resupply of services; or

  • Refund of the activity fee.

Freedive Geelong is not liable for indirect or consequential loss, including travel expenses, accommodation costs or loss of income.

15. Privacy

Freedive Geelong collects personal information for booking, safety and operational purposes. Information is handled in accordance with applicable privacy laws.

​

16. Governing Law

These Terms & Conditions are governed by the laws of Victoria, Australia.
